I acknowledge and agree that in the case of my child’s absence or voluntary withdrawal from a Program prior to the Program’s conclusion, which is not otherwise permitted by Synagogue, I will not be issued a refund for any fees paid or be relieved from any unpaid balances. Unpaid balances shall become immediately due and payable.
If the Synagogue, in its sole discretion, determines that the continued enrollment of a child is not in their or the Program’s best interest (or that the continued involvement of the parent(s)/guardian(s) is not in the best interest of the child or the Program), the Synagogue may request that the child be withdrawn and may refund a pro rata amount of Program fees paid.
I understand and agree that the Synagogue reserves the right to cancel any Tiny Tots, Early Explorers, Toddler Time, and Shabbat A Lot class where the minimum number of children enrolled is not reached. The Synagogue will refund Program payments if minimum enrollment is not reached.
I agree to notify the Synagogue immediately if the physical or legal custody or care arrangements for my child are temporarily or permanently altered. I agree to provide the Synagogue with any and all relevant court documents or orders.
I authorize Central Synagogue to seek medical attention for my child if needed.
If, as a result of the Synagogue’s relationship with the child, you, or any other person interacting with the Synagogue or Synagogue community by virtue of their relationship with the child, the Synagogue or any member of the faculty or staff is required to testify, provide information for, or otherwise participate in a legal dispute to which the Synagogue is not a party, the Synagogue shall be entitled to recover from me the Synagogue’s attorneys’ fees and costs incurred in such legal action and costs incurred by the Synagogue as a result of collection of documents, coverage of staffing, or other associated costs.
I release and hold harmless the Program, the Synagogue, and the Synagogue’s respective trustees, administrators, agents, representatives, and employees from all claims, damages, and other liability for injury or illness to my child or for loss of my child’s property, where such claims, damages, or other liability are not the result of gross negligence by the Synagogue, its trustees, administrators, agents, representatives, or employees.
The obligations of the Synagogue under this Contract may be suspended immediately without notice during periods that the Synagogue and its Programs must close because of force majeure events including, but not limited to, fire, acts of God, war, acts or threats of terrorism, governmental action, medical epidemics, pandemics, outbreaks, natural disaster, or any other event beyond the Synagogue’s control. If such an event occurs, the Synagogue’s duties and obligations under this Contract may be suspended or postponed until such time as the Synagogue, in its sole discretion, may safely re-open. The Synagogue is relieved from performance under this Contract whether or not the underlying force majeure event is foreseeable at the time of execution of this Contract. A force majeure event will not entitle the parent(s) or guardian to a Program payment refund.
